The Immigration and Naturalization department is extremely complex and in light of recent events, subject to change at very short notice. We work diligently to keep up to date with changes in regulations.

Investment Visa’s are issued to citizens of countries that have treaty agreements in place with the United States.

The investment E visa: Investors may qualify for employment creation immigration visas if they seek to enter the United States for the purpose of establishing a new commercial enterprise or to purchase an existing business.

The E2 visa requires a minimum investment of \$100,000 to qualify. This amount is liquid cash available to purchase a business. In addition to this you would need sufficient funds for living expenses for at least 6 months and in the case of new businesses, sufficient expansion funds available. For those wanting to create a new business has to provide sufficient evidence with a business plan of the probability of success and estimated revenue.

The E2 visa is usually issued initially for 1-3 years. The visa can be held indefinitely by maintaining the proper status of the business or enterprise within the US.

Business B1 visa This visa is appropriate for persons wishing to travel to the United States to survey potential sites and opportunities for business and stay for an extended time than 3 months. A B1 visa still only allows 6 months of travel to the US in one year for the holder. The holder of a B1 visa may not remain in the US to manage the business.

Intra company Transfer L Visa This visa is appropriate for an International company to expand business into the US or for transfer between subsidiary companies. This visa enables the holder to travel and stay in the US for a period to open and operate a branch, subsidiary or affiliate office of the same company.

The International company may be either a US Corporation or foreign organization. To qualify, the employee must be at the managerial or executive level, or have specialized knowledge and be destined to a position within the US company at either of these levels although not necessarily in the same position held previously. The transferring employee must have been employed with the International company outside of the US continuously for one year within the 3 years preceding the application for admission to the US.

When filing a petition for an L1 visa the international company will be required to show that sufficient physical premises to house the new office have been secured and that within 1 year of petition approval the US business entity will support an executive or managerial position.

Once an L-1 visa is issued it is possible to transfer to a ‘green card’ resident alien status with the appropriate application.

Resident Alien (Green Card) A minimum liquid investment for the issue of a resident alien status is \$1,000,000 into an existing business or start of a new business. There are also other stipulations that have to be considered, including employing 10 staff.

Timing : Due to increased security checks there has been an increase in time frames of petition approvals. Nothing is ever “quick” with the INS ! Currently time frames are :

E Visa – up to 6 months from application

B1 Visa – 9-12 weeks

L-1 Visa – regular submission is up to 6 months from application. The INS offers an express service for this visa, (for additional cost) which will guarantee an answer within 15 business days of application/petition.

Resident Alien (Green Card) is taking 1 year from application. Renewals are also taking 1 year.

Citizenship from Resident alien status is taking 1 year for approval.
